Terms of Service

Definitions

"Conditions" means these terms and conditions: "Personal Information" means any personal details provided by you via the Website; "User(s)" means (a) user(s) of the Website either collectively or individually, as the context requires; "We/us/our" means ConnectSwitch, "Website" means the website located at http://www.connectswitch.com or any subsequent URL which may replace it; and "You/your" means you as a user of the Website and Services.

Your obligations

You:

  • agree not to use the Website (or any part of) for any illegal purpose and agree to use it in accordance with all relevant laws.
  • agree not to upload or transmit through the VPS any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer.
  • will not upload or transmit through the VPS any material which is defamatory, offensive, or of an obscene or menacing character, or that may cause annoyance, inconvenience or needless anxiety.
  • will not use the VPS in a way that may cause the VPS to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the VPS is in any way impaired.
  • will not use the VPS in any manner which violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality or rights of privacy).
  • agree that in the event that you have any right, claim or action against any Users arising out of that User's use of the VPS, then you will pursue such right, claim or action independently of and without recourse to us.

Our rights

We reserve the right to:

  • modify or withdraw, temporarily or permanently, the Website/VPS (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.
  • suspend and/or terminate an account if an abuse report is submitted for any purpose. Account will be suspended straight away and an investigation will take place to check whether the claim/report has sufficient grounds for termination. Any downtime suffered by an abuse report is unclaimable.
  • change these conditions from time to time, and your continued use of the VPS (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the conditions have been changed. If you do not agree to any change to the conditions then you must immediately stop using your VPS.
  • deny any refund or compensation to a client who has breached these terms and conditions.
  • use our reasonable endeavors to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.

What can't I host?

Failing to abide by these guidelines will result in an account termination without any compensation/refund, therefore you must agree to not host the following:

  • Public or private IRC (Internet Relay Chat) related applications. This includes but is not limited to; bots, bouncers, eggdrops and IRCD servers.
  • Torrent related applications. This includes but is not limited to; trackers and client-side torrent software (eg: uTorrent).
  • Gameservers. This includes but is not limited to; Gameserver Daemons. This is due to the nature of the resources required by these applications.
  • Spam related applications. This includes but is not limited to; shell based spam scripts and web based spam scripts.
  • Services that are involved in a abuse situation will require a £20.00 re activation fee as a penelty and non refunable, if the penalty fee is not paid within 7 days the service will remain offline and terminated after a further 7 days should the fee not be paid.

Cancellations

The cancellation procedure is quick and painless, however there are certain procedures that need to be followed:

  • 7 days notice is required prior to the payment/invoice date.
  • cancellation requests must be completed through the billing area located here.
  • outstanding invoices that are not paid within 7 days from the due date will be passed to a debt collector.
  • Any refunds that need to be processed will require a 5 days holding period from the day of the request, Identification may be request to forfill the request.
  • Serivices that are not paid for on time will incure a 25% late payment fee on the 7th day for the total amount of your invoice.
